The Justification for Criminal Law Appeals

There are several incidents that can justify appealing a conviction. These include, but are not limited, to:

  • Evidentiary errors at trial where the judge has erred in excluding favorable evidence or admitted improper evidence.
  • Police misconduct, which may occur when law enforcement conducts the illegal search and seizure of a defendant's property. Misconduct can include illegal wiretaps, unlawful entry and tampering with evidence.
  • Prosecutorial misconduct, such as when a prosecutor withholds exculpatory evidence, to which the defense is entitled, and which would tend to disprove guilt.
  • Improper closing arguments where the prosecutor improperly shifts the burden of proof by questioning a defendant's rightful choice to not testify, to plead the fifth or request a lawyer before speaking with police.
